The reasoned decision was announced in the “Absolute Nullity” case filed with the request to cancel the CHP’s 38th Ordinary Congress. The Ankara 42nd Civil Court of First Instance ruled that “there was no basis for a decision because the case had become moot.”
The court stated that the actions of delegates alleged to have voted in exchange for benefits did not affect the validity of the election, as there was no concrete evidence. The request to cancel the congress at which CHP Chairman Özgür Özel was elected was thus rejected.
CHP Deputy Chairman Gül Çiftçi said the decision demonstrated that the judiciary cannot interfere with the democratic will of political parties. Çiftçi said, “This decision is not only a guarantee for our party, but for the democratic will of all political parties.”
