The Constitutional Court rejected the CHP’s request to annul the Grand National Assembly’s decision on the membership of the Council of Judges and Prosecutors (HSK) by a majority vote. The CHP had argued that the HSK elections were conducted in violation of Article 159 of the Constitution.
The majority of the Court rejected the application on the grounds of “lack of jurisdiction,” stating that the Grand National Assembly’s selection of HSK members did not concern the Assembly’s “working procedures and principles.” Hasan Tahsin Gökcan, Basri Bağcı, Selahaddin Menteş, and Kenan Yaşar dissented from the decision. The dissenting opinions emphasized that the Constitutional Court’s oversight authority over legislative proceedings had been narrowed and that the principle of the rule of law had been undermined.
