The Constitutional Court ruled that the right to a fair trial was violated as witnesses were not heard in court. The applicant, Selçuk Arslan, had been sentenced solely on the basis of witness statements received by appeal and the witnesses had not been heard in court or via SEGBİS. The Constitutional Court ruled that this process undermined the right to defense and violated the right to question witnesses.
