Constitutional Court denies miner families’ application to investigate politicians

The Constitutional Court (AYM) denied the application made by the families, who lost their relatives in the work murder in Soma, Manisa with 301 people dead to investigate whoever was responsible of the incident. “A lawsuit could always be filed against whoever is responsible,” the court stated, further expressing that the remedies were not exhausted and that other people deemed responsible could be prosecuted in the same lawsuit filed against mine owners. However, that case is at the stage of Court of Cassation and is about to end.

 

The families had applied at the AYM with the claim that inspectors of the Ministry of Energy and Natural Resources and the Ministry of Family, Labour and Social Services as well as the General Directorate of Work Health and Safety of the Ministry of Labour to be investigated; claiming that their relatives’ “rights to life have been violated” through the verdict of non-prosecution issued for those investigated.
