In the application of Hasan Fırat, who was injured during the police attack against the participants of Berkin Elvan’s funeral, the Constitutional Court (AYM) decided the mistreatment ban was violated and issued 10 thousand TL of moral indemnity to be paid. The court further decided that the Prosecutor’s Office didn’t collect evidence against the police and that it issued a verdict of non-prosecution solely based on Security Directorate documents, thus not being objective. However, the court didn’t issue a retrial for the police officers.
