A lawsuit of closure was filed by the Ministry of Commerce against Anadolu Kültür Incorporated, established by arrested businessman Osman Kavala. The company made a written declaration and stated that for the first time in the history of the Republic, a company faces a lawsuit due to conducting its work in a similar non-profit way with associations and foundations, indicating that the lawsuit is a “continuation of the unlawfulness faced by Kavala himself.”
The statement described the prosecution process as following: “In its evaluation of the ‘Gezi Events Investigation’, The Financial Crimes Investigation Board (MASAK) didn’t find any evidence that our company has committed a crime within the Criminal Code and wanted the Ministry of Commerce to investigate whether the activities of the company could be evaluated within the scope of a company or not. (…) After this evaluation, a case of closure was filed against Anadolu Kültür Inc. by the Ministry of Commerce in accordance with the Turkich Code of Commerce Article 210/3 with the allegation of ‘conducting its activity similarly with associations and foundations, that Anadolu Kültür Inc. was established with economic purposes and matters whereas provides a majority of its income through domestic and international donations and funds from institutions and persons.’” The statement made further recorded that there is no legal restriction stated in the Turkish Code of Commerce that prevents companies from getting funds through sponsorship.
