ECHR issues right violation in application on shutting down TAYAD

In the application made on the shutting down of the Association of Families of Convicts and Detainees (TAYAD) Adana Branch and for its executives to be penalized, the European Court of Human Rights (ECHR) decided that the freedom of association was violated and convicted Turkey.

 

Organizing a raid against TAYAD Adana Branch building in 2008, the police confiscated the signatures collected for PKK leader Abdullah Öcalan, a photograph belonging to Öcalan and Şopên Rojê newspapers. Immediately afterwards, a lawsuit was filed against the association executives with the allegation of “making illegal organization propaganda” based on the confiscated signatures and newspapers. Adana 6th Assize Court has sentenced the association executives to 2 years of imprisonment each due to the same charge; the sentences have been reversed by the Court of Cassation in 2012. However, similar decrees has been issued in the retrials later. The court has deferred the announcement of the latest verdict.
