The application made by Association for the Support of Contemporary Living (ÇYDD) executives, who were taken into custody within the ‘Ergenekon investigation,’ at the European Court of Human Rights (ECtHR) was concluded.
The court found Turkey guilty of ‘violating the right to freedom and security’ in the application of four ÇYDD members due to “being kept under custody without evidence against them” after a verdict of non-prosecution. No compensation was sentenced due to lack of claim from the applicants.
A lawsuit had also been filed against other ÇYDD members with the same charge and the defendants were acquitted on 2 October 2015 with a decree from Istanbul 5th Assize Court, eventually applying to the European Court of Human Rights. With a decree issued last year, the court has also decided for the unlawfulness of the arrest of members, issuing 24 thousand Euros of compensation to be paid to eight ÇYDD members.
