Constitutional Court decrees on police violence

The Constitutional Court (AYM) issued a decree of violation in the application of Evrensel Daily reporter Erdal İmrek, who was beaten by the police while attempting to follow the protest organised on the first anniversary of the Gezi Park protests. The journalist was detained, kicked by the police and tear gas was sprayed on his face. The Prosecutor’s Office had issued a verdict of non-prosecution for the complaint of the journalist. The Constitutional Court decided that the police violated the freedom of expression and press freedom of the journalist through preventing him from performing journalism; while violating the ban of treatments against human dignity through beating the journalist.

 

In the application of Istanbul Medical Chamber Secretary General Ali Çerkezoğlu, the Constitutional Court issued that his right to meeting and demonstration was violated when he faced police intervention as he attempted to participate in the May 1st protest organised in Istanbul. The court further stated that the beating of Çerkezoğlu was “mistreatment.”
