In the application of Kurdish politician and Partiya Kurdistani Chairman İbrahim Halil Baran, who was detained in Şanlıurfa in January 2017 due to his speeches and social media posts and was exposed to torture and mistreatment for 12 days under detainment, the Constitutional Court decided that the ban against torture and mistreatment was violated and reversed the verdict of non-prosecution issued by the Prosecutor’s Office on the matter.
The high court further decided that the freedom of expression of Metin Çapar was violated as well. Çapar criticised a post on social media that praised the 7th President of Turkey and the Chief of General Staff of the September 12 coup, Kenan Evren and said, “I will laugh at this statement with my backside, what a lack of political knowledge.” Afterwards, Çapar had been prosecuted due to “insult” and had been sentenced to 1740 Turkish Liras of judicial fine.
