The Council of Judges and Prosecutors (HSK) sent a warning letter to judges and prosecutors regarding the use of social media. The letter, sent by the HSK General Secretariat to all judicial units, drew attention to the impact of social media posts on the impartiality and independence of the judiciary and the public’s perception of trust. The letter emphasized that while members of the judiciary have freedom of expression, this freedom is subject to restrictions due to the nature of their profession. It stated that posts about ongoing or potential future cases, as well as political and social events, could undermine the perception of impartiality. The HSK reminded that posts on social media can have lasting effects even if deleted, and stated that judges and prosecutors should pay particular attention to their obligation to “appear impartial.”
