In the lawsuit filed on the death of Abdullah Cömert due to a tear gas shell hitting his head during the Gezi Park protests in Hatay, defendant police officer Ahmet Kuş was sentenced to 6 years, 10 months and 15 days of imprisonment due to ‘homicide through conscious negligence.”
Balıkesir 2nd Assize Court has previously sentenced police officer Kuş to 13 years and 4 months of imprisonment on March 14, 2016, due to ‘involuntary homicide’ with an abatement of “good conduct.” Denying the arrest claim against the defendant in each hearing, the court did not arrest the defendant police officer after the announcement of the verdict as well. The conviction was later reversed by the 1st Criminal Chamber of the Court of Cassation; this time Balıkesir 2nd Assize Court abated the sentence against the defendant police officer to half-time.
