In the application of Freedom and Solidarity Party (ÖDP) members, who were detained with a police raid at the party building in Edirne due to hanging a banner that said, “Thief, murderer AKP,” the Constitutional Court (AYM) decided that the “treatment against human dignity” and “freedom of expression” were violated. In the reasoned decision, the high court stated, “No matter how unacceptable the opinions and expressions directed against the ruling party might seem, the ruling power has a quite extensive responsibility to tolerate criticism. No matter how heavy the opinions and thought criticising policies of the ruling party are, sanctions must not be applied against the owners of those opinions because of them.”
