“There is disproportionate censorship in Turkey”

Council of Europe Commissioner for Human Rights Dunja Mijatovic presented her opinion in Wikipedia’s application at the European Court of Human Rights (ECHR) due to being censored in Turkey since April 29, 2017. Mijatovic indicated with amendments made on the Internet Law No. 5651 since 2014, Turkey has been extending the scope of censorship. The Commissioner evaluated that Internet censorship and online access in Turkey is regulated “extremely disproportionately.” Explaining the resistance of local courts against Constitutional Court decrees with various examples, Mijatovic underlined that this situation carries the meaning of a strike against judicial impartiality and Constitutional supremacy and law in Turkey. “I am sad that this development lead to questions in the effectiveness of the Constitutional Court as a domestic remedy. In the current state of affairs, the Constitutional Court can not be relied upon against violations based on Internet access bans.”
