The appeals court has overturned the ruling in the case concerning the death of 19-year-old Şahin Öner, who was killed when struck by an armored vehicle in Diyarbakır on February 10, 2013. The 3-year and 4-month prison sentence imposed by the Diyarbakır 1st Heavy Penal Court on police officer Selahattin Korkmaz for “causing death by negligence” was overturned by the Diyarbakır Regional Court of Appeals 3rd Criminal Chamber on the grounds of “excessive sentencing.” The appeals court stated that the conditions for conscious negligence were not met in the case. The case was sent back to the Diyarbakır 1st Heavy Penal Court for retrial, and the hearing date was set for February 11.
