Distributing leaflets banned at universities once again

The Council of State denied the objection against the article that penalizes distribution of leaflets without permission with reprimand. An amendment was made on the Higher Education Institutes Student Disciplinary Regulation on November 7, 2013 and distributing leaflets in higher education institutes without permission were included among the actions that required a penalty of reprimand. An objection was made by the Education and Science Workers’ Union (Eğitim-Sen) on the amendment, therefore a stay of execution was issued on the amendment.

 

8th Criminal Chamber of the Council of State stepped back from their previous decree and considered it a crime to distribute leaflets without permission. Council of State Prosecutor Ayşe Bal Gül voted against the decision, underlining that the regulation that binds people’s rights to announce and distribute their opinions through writings, arts and other means to permission is against the main principles of the Constitution and that it will lead to arbitrary applications by school administrations.
