The dispute over the court in charge of the lawsuit filed over alleged irregularities in the CHP’s 38th Ordinary Assembly held on November 4-5, 2023 was brought to the Constitutional Court. Evaluating the application of Ankara 26th Criminal Court of First Instance, the Constitutional Court rejected the application on the grounds that “there is no rule to be applied”.
Thus, the case will continue at the Ankara 26th Criminal Court of First Instance.
The indictment prepared by the Ankara Chief Public Prosecutor’s Office names 12 defendants, including Ekrem İmamoğlu, the dismissed and currently detained IBB Mayor. The defendants are facing up to 3 years in prison and a political ban on charges of “rigging the vote” under Article 112 of the Law on Political Parties.
In the case, which was the subject of debate for a long time due to the decisions on the lack of jurisdiction, the Constitutional Court ruled that the case will definitely be heard at the Criminal Court of First Instance.
The first hearing of the trial regarding the CHP congress will be held on September 15 at Ankara 26th Criminal Court of First Instance.
