Precedent setting decision by the Constitutional Court: Forced sampling of Esin Kavruk deemed “torture”

The Constitutional Court ruled that the “prohibition of treatment incompatible with human dignity” was violated in the application of nurse Esin Kavruk, whose saliva sample was forcibly taken in Bakırköy Women’s Closed Prison.
The court found a violation on both substantive and procedural grounds and ordered the applicant to pay 100 thousand TL in non-pecuniary damages and 30 thousand TL in legal costs.
It was stated that during Kavruk’s detention in 2019, a security team of about 100 people raided the prison ward, female detainees were beaten and forced samples were taken.
Lawyer Gülizar Tuncer said the ruling is a historic case law on “forced production of evidence and interference with bodily integrity”.
