The Constitutional Court (AYM) ruled that there have been violations in the applications regarding the access bans against certain news published in Birgün, Gazete Duvar, Artı Gerçek, Sol.org.tr, Diken and against a column by Çiğdem Toker published in Cumhuriyet Daily. Referring to the recommending decree of the Committee of Ministers of the Council of Europe to member states on internet freedom as well as to the jurisprudence of the European Court of Human Rights (ECtHR) on the internet and freedom of expression, the high court ruled that the right to freedom of expression and the press regulated in Articles 26 and 28 of the Turkish Constitution, as well as the right to an effective application regulated in Article 40 of the Turkish Constitution, had been violated with the access bans. The court further issued 8 thousand 100 Turkish Liras of non-pecuniary damages and litigation expenses to be paid separately to each applicant.
