In the retrial on the deaths of 8-year-old Enes Ata and 14-year-old Mahsum Mızrak, who died due to the tear gas shells hitting their bodies in the incidents in Diyarbakır in 2006, defendant police officers were acquitted once again. The decree of acquittal issued by Diyarbakır 1st Assize Court for the three defendant police officers, who were charged with “homicide with eventual intent,” was previously reversed by the appeal court. The court claimed that no sufficient evidence was collected on the defendants in the retrial and issued another decree of acquittal for the police officers.
The evidence of the file were lost at the Property and Evidence Unit; meanwhile the radio recording of the police officer during the incident were destroyed without a court decree.
