The Supreme Electoral Board (YSK) published its justification for the decision to lift the suspension of CHP’s congresses in 5 districts in Istanbul and rejected the objection to suspend the provincial administration.
In the justification, it was stated that, in accordance with Article 79 of the Constitution, it is the duty of the SBE to conduct elections in an orderly manner, to ensure the integrity of the elections and to finalize all election objections.
It was emphasized that election boards are only given limited supervision authority in political party congresses and that election boards are not authorized for “pre-election” procedures other than the approval of the lists of members who will attend the congress.
The SBE stated that it has been consistent in its jurisprudence that election judges can only supervise election day and post-election procedures, and that requests such as the cancellation of congresses fall within the jurisdiction of the judicial judiciary.
Referring to the 2006 decision, it was underlined that the oversight authority of election boards in political party congresses is much more limited than in general elections.
