European Court of Human Rights (ECtHR) decided that Turkey has violated “the torture and mistreatment ban” in the application of Mehmet Uğraş Vatandaş; deciding for 12 thousand Euros of indemnity to be paid.
Vatandaş had been taken into custody in Istanbul during a protest on 6 April 2002 and was released the same night. In the lawsuit filed following the criminal complaint of Vatandaş, claiming that he was exposed to torture and mistreatment while being taken into custody, the court decided for the acquittal of the police officers by asserting that there is no evidence on the crime, that “the identities of the police officers intervening the protest could not be determined.” The Court of Appeals has later concluded the case, deciding for an exceeded time limitation on 14 June 2011.
