10th Penal Chamber of the Council of State issued that there is an administrative neglect in the case regarding the assassination of the Confederation of Progressive Trade Unions of Turkey (DISK) Founder-Chairman Kemal Türkler, who was killed 38 years ago.
Türkler has lost his life in the assassination against him in front of his house on 22 July 1980. Due to the case being remained under impunity due to time limitation, Türkler’s family demanded compensation from the Ministry of the Interior and the Ministry of Justice. The application was denied by the administrative court, whereas the denial was reversed by the Council of State.
One of the perpetrators of the assassination, Ünal Osmanağaoğlu has been acquitted in 2003 due to lack of sufficient evidence. The verdict was reversed four times by the Court of Appeals; whereas the local court insisted on the verdict of acquittal. As a result of years of unlawfulness, the case was abated due to time limitation.
10th Penal Chamber of the Council of State decided that the proceeding of the defendant was lengthened unnecessarily by fault of service, causing the abatement due to time limitation. The decree of reversal was sent to the administrative court for reissue.
