The Constitutional Court decided that the local administrator not allowing for an investigation against a Deputy Mayor, who attempted to prevent the organisation of the General-Labour union of the Confederation of Progressive Trade Unions of Turkey (DISK) at a municipality, violated the right to professional organisation. The high court stated, “The government is responsible for active investigation and prosecution when necessary as a requirement of the positive responsibility against the crime of prevention of professional union activities.
