The Constitutional Court ruled that urban planner Tayfun Kahraman’s right to a fair trial was violated in the Gezi trial. Despite the dissenting votes of five members, the majority ruling sent the case to Istanbul 13th High Criminal Court for retrial. The reasoned decision stated that the local court and the Court of Cassation failed to establish a concrete link between Kahraman’s actions and the evidence, restricted his right to defense and violated the principle of “equality of arms”. The Constitutional Court also drew attention to the contradiction between previous acquittals in the Gezi protests and the current verdict.
