The Constitutional Court ruled that the procedural aspect of the prohibition of persecution was violated due to the lack of an investigation into E.A.A., who was subjected to police violence during the Gezi Park protests. The Constitutional Court stated that despite its first violation decision in 2020, the prosecutor’s office did not take any action for 1 year and 4 months, and therefore the case was time-barred. It emphasized that it is no longer legally possible to reopen an investigation. Five members opposed the decision, arguing that the statute of limitations should restart as of the Constitutional Court’s decision and the investigation should be opened.
