The Constitutional Court ruled that Yanardağ’s statements about Öcalan on TELE1 in 2023 did not constitute a call for force/violence and that the right to personal liberty and security had been violated. It awarded 166,500 TL in moral damages and sent the decision to the Istanbul 30th Criminal Court of First Instance, which had imposed a 2-year, 6-month prison sentence. Members İrfan Fidan and Muhterem İnce dissented. Yanardağ remains in custody as part of the Istanbul Metropolitan Municipality “espionage” investigation.
