The Constitutional Court (AYM) unanimously decided that the decree of compensation issued against Fikri Sağlar, who criticised the fact that Maraş Massacre defendant Ökkeş Şendiller was invited to a December 2009 session of the workshop series publicly known as the “Alevi Initiative” with the expressions, “will those who have Alevi blood on their hands explain how they massacred them?” was “not a violation of freedom of expression.”
Six court members, including Chief Judge Zühtü Arslan, did not agree with the decree. Among the justifications of the decree, attention was drawn to the fact that “acquittal due to lack of evidence in a criminal trial does not need to be taken as a basis for public opinion” and that “both Sağlar and Şendiller being politicians must also be taken into account”.
