The Constitutional Court ruled that the exclusion of the simple form of the offense of insult and the offense of insult against a public official from the scope of prepayment is unconstitutional. The Supreme Court canceled the relevant regulation, stating that this difference caused inequality between persons in similar legal situations.
In the decision, it was stated that the amendments made by Law No. 7531 were contrary to the prepayment practice within the framework of Article 75 of the Turkish Penal Code. The Court also found it unconstitutional to subject only the files that were subject to investigation or prosecution before the amendment to reconciliation.
The annulment will take effect 9 months later.
