The Constitutional Court decided that “freedom of expression was not violated” in the application of Kadri Pervane, who was sentenced to 2 years in prison for “making propaganda for a terrorist organization” due to the Kurdish song “Biji”, which he listened to on the public bus he was driving. The high court argued that the sentence given to Pervane “corresponded to a pressing social need, was proportionate, and that this intervention was not contrary to the requirements of the democratic social order”.
