The Constitutional Court (AYM) decided that the right to organise meetings and demonstrations of university-student Duran Eren Şahin, who was shot with a tear gas shell by the police during the Gezi Park protests, was violated. The court issued for 20 thousand TL of moral compensation to be paid to Duran Eren Şahin. In the criminal complaint made on the matter, the Security Directorate claimed that the officer using the tear gas equipment could not be identified and the Prosecutor’s Office issued a “verdict of non-prosecution,” claiming that the police have performed their duty. The high court described the incident as a “treatment against human dignity” and decided for the previously shut-down investigation file to be re-opened, indicating, “the government must immediately react against complaints with allegations of mistreatment and therefore avoid a permissive attitude on such matters.”
