The Constitutional Court (AYM) decided that the right to freedom of expression of university student Meki Katar, who had been sentenced to 1 year and eight months of imprisonment due to “making illegal organisation propaganda” through the marches and slogans he chanted during the Roboski Massacre commemoration organised in 2013 at Malatya University, was violated. The high court pointed out that despite their similarity with political ideologies, expressions not inciting towards violence can not be considered propaganda. “No matter how disturbing such expressions are for government authorities or the majority of society, they are protected by freedom of expression,” the court stated. AYM issued 9,150 TL moral indemnity to be paid to the applicant and for the case file to be sent to Malatya 3rd Assize Court for retrial.
