In the application of the citizen, who was dismissed from public service following disciplinary penalties against her due to wearing a headscarf, the Constitutional Court issued that the headscarf ban is a violation of freedom of faith. The court issued 20 thousand TL compensation to be paid to the applicant.
Indicating that the principle of secularity in the Constitution assigns positive and negative responsibilities to the government, the court stated, “The negative responsibility brings avoidance of intervention with the right to freedom of religion without obligatory reasons, and the positive responsibility requires the government to remove obstacles against the freedom of religion and to provide suitable conditions for people in which they can live in accordance with their beliefs.”
