The Constitutional Court (AYM) found the allegation of violation of the right to education unacceptable in the application of an arrested university student due to inability to attend central exams and continue his education in prison.
The court issued no violation of the right to education in the application of Anadolu University Department of Social Services student Müjdat Gürbüz, who was arrested due to ‘FETÖ membership.’ Deciding that the inability of convicts from continuing their full-time academic activities can not be evaluated as a deprivation of the right to education, the Constitutional Court claimed that the Constitution does not impose a positive responsibility on the government on the subject and that it is up to the lawmaker whether to allow attendance of convicts or those arrested due to terror charges in central examinations.
