The European Court of Human Rights (ECtHR) found Turkey guilty of many charges, including “violation of the right to fair trial” and “period of arrest”, in the application of Ruşen Bayar, who is currently in Tekirdağ Prison. The court identified violations in a total of six articles of the European Convention of Human Rights, issuing 7609 Euros of moral compensation and court expenses to be paid to Bayar.
Ruşen Bayar is now 47 years old and has been arrested in November 2003 due to “PKK membership.” In the indictment prepared against him after a month, he was charged with “opening fire to a police vehicle, participating in a protest that led to the injury of police officers, homicide and terrorist organization membership.” The first hearing was held in December 2004 at the Istanbul State Security Court of the time; Bayar denied all allegations. He was prosecuted for five years under arrest and eventually was convicted by Istanbul 13th Assize Court.
