On September 10, 2025, the Constitutional Court unanimously ruled that the regulations concerning draft dodging and desertion were not unconstitutional; the decision was published in the Official Gazette on December 29, 2025. The Çorum 3rd Criminal Court of First Instance raised the issue of both administrative fines and prison sentences being imposed for the same offense, as well as repeated trials. The Constitutional Court ruled that desertion and failure to report for military service constitute continuous offenses and that it is not contrary to the law to bring another case for the same act. The court also emphasized that military call-ups made via TRT and e-Government are considered valid notifications. The decision paved the way for conscientious objectors to be retried for years for the same offense.
