The Ankara 22nd High Criminal Court rejected the application for release of Selahattin Demirtaş and Figen Yüksekdağ following the ECHR’s violation of rights verdict against them on the grounds that “the verdict has not been finalized”.
The court stated that Demirtaş, Yüksekdağ and other detainees in the Kobanê Case had been convicted on charges of “disrupting the unity of the state” and “membership in an illegal organization”. In the justification, it was stated that the ECHR ruling had no effect on the duration of detention and that the jurisprudence of the Court of Cassation and the Constitutional Court was taken into consideration. The court argued that the convictions were sufficient for continued detention.
