The Constitutional Court (AYM) ruled that the treatment report given to the mother of a mental health patient without her knowledge was a “violation of the right to protection of personal data”. The patient had filed a criminal complaint stating that the doctor had forwarded the report to her mother even though she had a conflict of interest with her mother. Although the local court acquitted the doctor, the Constitutional Court stated that the trial was not based on sufficient grounds and that the positive obligation of the state was not fulfilled. Decision sets a precedent on patient privacy
