Antalya 13th Civil Court of First Instance applied to the Constitutional Court for the annulment of the first paragraph of Article 40 of the Turkish Civil Code in the gender reassignment case of a homosexual woman. The court requested annulment on the grounds that the article defines the distinction between men and women on a biological basis, that it may affect social order and that it is contrary to Articles 10 and 50 of the Constitution. The Constitutional Court has passed the application through the first examination and will conduct the substantive examination on a date to be determined. Previously, the “deprivation of reproductive capacity” clause of the same article was annulled.
