The 1st Criminal Chamber of the Court of Cassation upheld the 16-year and 8-month prison sentence given to Fatih Dalgalı, the police officer who shot 14-year-old Berkin Elvan with a gas canister during the Gezi Resistance, causing his death. The sentence was given on the charge of “killing with probable intent”. Following the verdict, the execution process will be initiated and an arrest warrant is expected to be issued for Dalgalı. Two members of the Court of Cassation dissented from the verdict and argued that Dalgalı, who was not arrested during the trial and continued his profession, should be sentenced to aggravated life imprisonment for “qualified intentional homicide”.
