The 3rd Civil Chamber of the Court of Cassation reversed the decision on the dismissal of the Turkish Medical Association (TMA) Central Council on procedural grounds. In the decision, it was emphasized that the prosecutor, who was the plaintiff, did not attend the case and the council members were not heard, violating the right to be heard.
The lawsuit was filed after former TMA President Şebnem Korur Fincancı made statements about the “use of chemical weapons” by the Turkish Armed Forces. A criminal case was filed against Fincancı and the TTB administration was dismissed due to “activities against the purpose of the union”.
In a statement, the TMA said that the reversal decision is an indication of unlawfulness and that they expect the case to be dropped.
