Constitutional Court ruling on cases involving ‘insulting the President’

The Constitutional Court ruled in favor of academic Yaman Akdeniz in an individual application filed after the Ministry of Justice refused to share statistics on cases involving “insulting the President” and Article 301 of the Turkish Penal Code. The Court ruled that freedom of expression had been violated in connection with the right to information and decided that the relevant data should be provided to Akdeniz. Akdeniz stated that the process had lasted six years and that the violation of his rights had been confirmed by the Constitutional Court’s decision following administrative and judicial appeals.
