The Constitutional Court ruled that the fine imposed on lawyer Süleyman Sırrı Kuş for sharing a cartoon depicting former Turkish Bar Association President Metin Feyzioğlu with the word “yavşak” violated freedom of expression. Kuş was fined 3,480 TL in 2019 for his social media post. In its ruling, the Constitutional Court emphasized that the cartoon was a form of expression containing humor and criticism, stating that “offensive expressions are also protected.” The court found that the lower courts had failed to consider the context and had not struck a fair balance between freedom of expression and personal rights. It ordered a retrial and the payment of 34,000 TL in moral damages to Kuş.
