The Constitutional Court (AYM) rejected the release application of Beylikdüzü Mayor Mehmet Murat Çalık on health grounds.
Çalık’s lawyers had argued that his client had been treated for cancer in the past, underwent surgery for suspected lymphoma and underwent angioplasty, and that prison conditions were not suitable for his health.
The Constitutional Court rejected the release request and issued a cautionary decision to protect Çalık’s life and health. In the decision, it was stated that regular medical check-ups in prison, examinations and treatment when necessary, referral to a hospital and all precautions should be taken.
In its reasoning, the court stated that the life risk was not at a level that required release and that the Constitution does not stipulate a general obligation for release on health grounds. However, it was emphasized that Çalık’s illnesses carried a serious risk and the prison administration was obliged to take all necessary measures.
