A contracted secretary at the Consulate General of Lyon was dismissed from her job for sharing Selahattin Demirtaş’s book on Instagram with the message “Hope to break all prejudices”. The reason given was the expressions contained in the book. However, the administrative court ruled that the post was within the scope of “freedom of expression” and ordered the reinstatement of the employee and the restoration of all his rights.
The court ruled that there was no recall or ban on the book and that the employee’s comment was within the scope of personal expression and did not damage the reputation of the organization. The administration’s decision was annulled as unlawful.
The Court of Appeal and then the Council of State upheld this decision. Thus, the employee’s return to work, the restoration of his/her personal rights and the payment of the monetary losses incurred with interest were finalized.
