The Istanbul 13th High Criminal Court rejected the request for a retrial despite the Constitutional Court’s ruling that the right to a fair trial had been violated in the case of urban planner Tayfun Kahraman. The court accused the Constitutional Court of “acting as an appellate body” and refused to comply with the ruling on the grounds of “usurpation of authority.”
Kahraman’s wife, Dr. Meriç Demir Kahraman, reacted to the decision, saying, “I don’t know what to do when the Constitutional Court’s decision is not implemented.” Tayfun Kahraman, who has been in custody for four years, is reported to be experiencing health problems. Following the decision, new applications and appeals are expected to be filed in the case.
