The court complied with the decree issued by the Constitutional Court (AYM) on the access ban brought on the news article published on Bianet in 2006 and removed the access ban against it. The Constitutional Court had accepted the objection against the access ban brought on the news article published on bianet on August 30, 2006 and called it a “violation of freedom of expression.”
Istanbul 7th Criminal Judge of Peace Ersin Öztürk indicated, in his verdict, that the Constitutional Court decrees are binding. Issuing all access bans on the news article to be removed together with their consequences, Öztürk stated, “The first thing that needs to be done for the first-degree courts immediately after the Constitutional Court decree is to reverse the court decree that caused the violation and then issue a new verdict that is in accordance with the new decree.”
