The Constitutional Court (AYM) ruled that the practices of recording the closed visits of detainees and convicts in prisons with technical devices and uploading their letters to the UYAP system violate constitutional rights. The decision stated that the right to privacy and freedom of communication were violated.
Evaluating the application of Ömer Coşkun, a convict in Keskin Prison, the Constitutional Court emphasized that the practices did not have a clear legal basis, violated the principle of “legality” and did not comply with the requirements of the democratic social order.
The court ordered Coşkun to pay 30 thousand TL in non-pecuniary damages and ordered a retrial due to the recording of closed visits. The decision was taken unanimously by the Constitutional Court members.
