The Constitutional Court (AYM) decided that the right to personal freedom and safety of former judge Mustafa Özterzi was violated due to his arrest being unlawful. Özterzi had been arrested with the allegation of “FETÖ membership” after the July 15 Coup Attempt and was acquitted after prosecution. The court issued 27,500 TL of moral compensation to be paid to Association of Judges and Prosecutors (YARSAV) member former judge and indicated that a decree of dismissal with a Statutory Decree “by itself can not be considered a strong indicator for crime.”
