Constitutional Court issues three decrees for freedom of expression

The Constitutional Court issued three decrees closely concerning freedom of expression and the right to petition. The court decided that the rights to freedom of expression of journalist Erbil Tuşalp, who was sentenced to pay compensation in 2014 due to writing an article criticising Fethullah Gülen, of Bugün (Adıyaman) Daily writer Abuzer Demir and Managing Editor Aslı Pekezer, who were penalised due to the articles and news criticising high-rank bureaucrats. The decrees specifically pointed out the extensive borders of expression and criticism of the journalists.

 

Another decree by the Constitutional Court stated that it is a violation of the right to freedom of expression and petition to penalise the citizen, who wrote a letter criticising a court decree. The citizen had been sentenced to a judicial fine due to his expression in the letter: “Even a third year law student could correctly interpret the decree.”
